Marriage and Divorce

Hindu Marriage Act 1955 lists four conditions of marriage – the two partners should be monogamous, of sound mind, of marriageable age and not close relatives.

Special Marriage Act 1954 provides that the boy should be above 21 years, the girl over 18 years, both monogamous of sound mind, not epileptic, not close relatives (except where local custom permits).

Christian Marriage Act 1872 allows marriage with a non-Christian. The boy should be over 21 years, the girls over 18 years.

Under the Hindu Marriage Act 1955 adultery is a ground of divorce for both male and female. Under the 1981 amendment to this Act Sections 13 E and 28 C restrict a decree for divorce unless the court is satisfied that adequate provision for maintenance of minors is made.
