Legal Procedures For Building Construction

Building permit requirement: No person shall erect, re-erect or make material alteration or demolish any building or part thereof without first obtaining a separate building permit for such building activity from the authority.
Application for building permit:
Every person who intends to erect, re-erect or make material alteration in any place building or part thereof shall given an application in writing to the authority in the prescribed form. Plans and statements in quin-tuplicate shall accompany such application.
Information accompanying application for building permit:
The application for building permit should be accompanied with the site plan, building plan, service plan, and specification as prescribed in bye-laws.
Application for building permit:
The following shall accompany the application for building permit in the case of permission for erection, re-erection or making material alterations.
Key plan
- A key plan drawn to a scale of not less than 1: 10,000 shall be sent along with the application.
Site plan
- Plan sent with an application shall be drawn to scale of not less than 1:500 for areas up to 1 hq and shall show.

  1. The boundary of the site
  2. The position of the site in relation to neighboring street
  3. The name of the street in which building is proposed
  4. All existing buildings standing on over or under the site
  5. The position of the building
  6. The means of access from the street to the building
  7. Space to be left in and around the building
  8. The width of the street (if any) in front and at the side of rear of the proposed building
  9. The direction of north point relative to plan
  10. Any existing physical features, such as wells, drains, trees etc.
  11. Aerial, electric supply line, water supply line, drainage line

Building plan. The plan of the building and elevations and sections accompanying application shall be drawn to a scale not less than 1: 100. The plan shall

  1. Include the floor plans of all floors together with the covered area
  2. Show the use of occupancy of all parts of the building
  3. Show exact location of essential services
  4. Include sectional drawing showing clearly the size of footings, thickness of basement wall construction
  5. Show all street elevations
  6. Include terrace plan indicating the drainage portions with open spaces

Service plan. Plans, elevations and sections of private water supply and sewage disposal system independent of the municipal services
Specifications
General specifications giving type and grade of materials to be used·shall accompany the application
Ownership title.
Every application for building permit shall be accompanied by the following as proof of ownership:

  1. Attested copy of the original sale/lease deed
  2. Attested copy of revenue survey sheet/municipal survey sheet
  3. Affidavit of other documents acceptable to the commissioner, MCH
